TU01 - Temporary Use of Government Property

Service Description
This service is intended for those who may require the temporary use of government property (including public spaces) for such purposes as luna parks, sports events, street parties, bill boards, campingetc. These activities require a GPD permit for the temporary use of the property. The permit granted is typically on encroachment terms and may therefore be withdrawn by GPD via a simple notification. Where the activity is being held in a public space (e.g. streets and squares), and does not exceed 40 days in duration, only a permit from the respective Local Council is required - i.e. no permit from the GPD is required.

Procedure
An application for the temporary use of a public space or other property may be made by means of a simple letter addressed to the Estate Management Directorate, Auberge de Bavière, Valletta. Applications are normally processed on a first come first served basis. The application must be received by the Estate Management Directorate a clear 10 working days prior to the intended date of use, otherwise GPD cannot guarantee that it will be able to issue the relative permit. If approved a permit will be issued at a fee payable in advance. The fee varies with the type of activity, the length of use, the area of the site in square meters and the locality. Permits granted by GPD do not exonerate the permit holder from obtaining any other permit that may be required in terms of any other law or regulation in force in Malta.

You are reminded that if the temporary use is required for more than 28 days a development application with the Malta Environment & Planning Authority (MEPA) may be required. In such case GPD will not normally consider your application before you provide a copy of the relative permit issued by MEPA. The Development Notification Order 2001 and the Development Notification (Exemptions) Order 2001 provide guidance as to whether a development application to MEPA is required. You are however advised to seek advice from an architect.

Documents Required
i) A letter application containing such details as;

(a) name of applicant;
(b) mailing address of applicant - and possibly the e-mail; address, (c) telephone number - including Mobile;
(d) description of property required;
(e) the use required; and
(f) the period required.

ii) Site plan showing clearly the property requested;

iii) Other requirements as may be requested.

Processing Fees
No processing fees (other than permit fees themselves) are charged for this service.

 

TU02 - Filming on Government Property


Service Description

This service is intended for those who may require the temporary use of government property (including public spaces) for filming purposes. Such activity requires a GPD permit.

Procedure
An application for the use of government property for filming activities may be made to the Estate Management Directorate. Such application should however be channelled through the Malta Film Commission, Enterprise Centre, san Gwann SGN 3000 Malta. The Malta Film Commission shall then liaison with the EMD regarding the possibility of an encroachment permit. Fees charged vary with the site location, site area and duration of the activity.

The application must be received by the Estate Management Directorate a clear 10 working days prior to the intended date of use. Otherwise the timely issue of the permit cannot be guaranteed. Applications are normally processed on a first come first served basis.

Filming activities also require the installation of an insurance policy. Permits granted by GPD do not exonerate the permit holder from obtaining any other permit that may be required in terms of any other law or regulation in force in Malta.

(b) mailing address of applicant - and possibly the e-mail address;
(c) telephone number - including Mobile;
(d) description of property required;
(e) the filming production to be undertaken; and
(f) the period required.

ii) Site plan showing clearly the property requested;

iii) Other requirements as may be requested.

TU03 - Placing of Tables & Chairs in a Public Space

Service Description
The use of public spaces by catering establishments/bars to place tables and chairs is also governed by the Disposal of Government Land Act and requires a permit by the GPD. GPD will normally grant such a permit if the placing of tables and chairs in the indicated public space is in accordance with the relative provisions of the Development Notification Order 2001, or otherwise has been approved by the Malta Environment & Planning Authority (MEPA).The placing of tables and chairs in a public space for very short (non-repetitive) periods - e.g. 5 days during village feast-week - does not require a GPD permit. A permit from the respective local council is however required).

Procedure
An application must be made on Form TU03 which is downloadable at this website. This application form should be submitted to the Malta Tourism Authority (MTA), who upon confirming the existence of a valid trading licence, shall forward it to the GPD's Estate Management Directorate (EMD) for further consideration. Assuming that site applied for is government property, GPD will normally consider the request in terms of the GPD Parameters for Granting of Tables & Chairs Permits. If approved permit will be issued against a fee. Applicant will be duly informed when the permit is ready and he/she will be asked to sign it and pay the relative encroachment fee. Once issued a Tables & Chairs Permit may be automatically renewed from year to year unless otherwise decided by GPD at its sole discretion.Typically permits are issued under the Standard Conditions for Tables & Chairs, but additional ad hoc conditions may be made. Should MEPA or MTA decide that permit should be withdrawn the GPD will withdraw its permits immediately.
